The Contract shall commence on the date of the Order and, subject to these Conditions, shall continue in force for the period set out in the Customer’s chosen Service Level unless terminated earlier in accordance with clause 7.

During each period of the Contract the Customer will pay to Hobart the Standard Contract Fee. In addition, if the Hobart Technician determines that the Equipment requires major repairs, which are not covered by the Contract, those costs will be charged to the Customer separately on an ad-hoc basis. A written estimate of the cost of such repairs will be provided to the Customer and, upon the Customer’s acceptance of that estimate, will be commenced.

Hobart will supply parts and labour to repair or maintain the Equipment during the term of the Contract, except for those parts which are deemed by a Hobart technician to be consumable/ancillary/accessory to or attached to the Equipment which shall be charged at Hobart’s Charge Rate. In addition, where the Equipment is unable to be repaired, Hobart will replace it with new equipment at its then current list price.

If during the course of any routine inspection the Hobart Technician determines that the equipment is in a dangerous condition and/or may be unsafe to use, then the Contract will be suspended until such time as the matter is rectified to the reasonable satisfaction of a Hobart Technician. Similarly, if the Hobart Technician determines during the course of any routine inspection that the Equipment is beyond economical repair or deemed obsolete then the Contract will be terminated.

Any returns of parts supplied by Hobart must be notified to and authorised by the relevant Hobart UK manager prior to returning any such part. Any parts returned without authorisation will not be accepted for return nor credited to the Customer. Any authorised returns of new parts must be made within 30 days of the invoice date and will only be accepted for credit if the original packaging is unopened.
